Terms of Service

The rules of using Tumobird Discord bot hosting. Last updated 2026-04-23.

Agreement

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Tumobird Bot Hosting ("Tumobird", "we", "us"). By creating an account or using any Tumobird service, you agree to these Terms. If you don't agree, don't use the service.

Account eligibility

You must be at least 13 years old and capable of entering into a binding contract. If you're creating an account on behalf of a company, you represent that you have authority to bind the company. One person or organization per account. Account credentials must be kept confidential.

Acceptable use

You may use Tumobird to host Discord bots and services related to those bots. You must not use Tumobird for any of the following:

  • Any activity that violates Discord's Terms of Service, Developer Terms, or Community Guidelines.
  • Hosting bots designed to spam, harass, or phish Discord users.
  • Hosting bots that distribute malware, CSAM, or content illegal in the US or EU.
  • Circumventing Discord rate limits, API restrictions, or anti-abuse systems.
  • Reselling Tumobird hosting capacity as an undifferentiated service (white-labeling for an included feature of a larger product is fine).
  • Cryptocurrency mining, proof-of-work computation, or any workload not related to Discord bot functionality.
  • Attacking Tumobird infrastructure, other customers, or third parties from Tumobird infrastructure.
  • Running distributed denial-of-service tooling, port scanners, or brute-force tooling.
  • Any activity that meaningfully degrades service for other customers on shared tiers.

We reserve the right to suspend or terminate accounts that violate this policy. For clear-cut violations (CSAM, active attack) suspension is immediate. For ambiguous cases we'll contact you first.

Your content and code

Your source code, environment variables, user data, and Discord bot configuration remain yours. You grant Tumobird a limited license to process, cache, and transmit that content only as necessary to operate the service. We don't claim ownership over any of it.

You are responsible for the code you deploy and the data it processes. If your bot collects data from Discord users, you're responsible for your own privacy policy and any consent flows required by applicable law.

Billing and payments

Paid plans are billed monthly or annually, in advance, based on the tier you select. Prices are in US dollars unless your local billing page says otherwise. Card charges are processed by Stripe. You authorize us to charge the payment method on file for all subscription renewals until cancelled.

Plan changes take effect immediately. Upgrades are prorated. Downgrades apply at the next billing cycle. If a payment fails, we'll retry three times over seven days and send email notifications. After seven days of unresolved payment failure we may suspend the deployment; after thirty days we may terminate the account.

Free trials

New accounts receive a 14-day free trial of the Hobby tier with no credit card required. At the end of the trial, your deployments are paused until you choose a paid plan. Paused deployments retain their environment variables and configuration for 30 days.

Refunds

We offer full refunds within 30 days of first payment if the service fails to deliver the advertised functionality due to a Tumobird platform issue. Refunds are otherwise at our discretion. The 14-day free trial replaces a general-purpose refund window; if you're unsure about whether Tumobird will work for your bot, use the trial instead of paying first.

Service level agreement

We target and publish a 99.9% monthly uptime SLA on all paid tiers. "Uptime" means your deployment's container reports healthy and is reachable by the Discord gateway from at least one Tumobird region. If the SLA is missed in a calendar month, you can request a service credit equal to one day of the affected plan for each full hour of downtime below the target, up to 30 days per month.

Service credits must be requested within 30 days of the incident via [email protected]. SLA exclusions: scheduled maintenance (announced at least 7 days in advance), customer-caused outages (misconfigured bots that crash-loop), Discord platform outages, and force-majeure events.

Suspension and termination

You can cancel your account at any time from the dashboard. Cancellation stops future billing and immediately pauses deployments (code and environment preserved for 30 days, then permanently deleted unless you reactivate).

We may suspend or terminate an account for: repeated violations of the Acceptable Use policy, unpaid balances past 30 days, fraudulent payment activity, or legal compulsion (court order, sanctions compliance). Except for clear-cut abuse cases, we'll contact you before terminating.

Warranties and disclaimers

Tumobird is provided on an "as is" basis. We don't warrant that the service will be error-free or uninterrupted, though we obviously try hard to make it so. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this disclaimer removes the SLA commitments above.

Limitation of liability

To the maximum extent permitted by law, Tumobird's total liability for any claim arising out of these Terms or the service is limited to the greater of (a) the total fees you paid to Tumobird in the 12 months preceding the claim, or (b) $100 USD. We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or goodwill, even if we've been advised of the possibility.

Indemnification

You agree to indemnify Tumobird against third-party claims arising from: your Discord bot's content or behavior; your violation of these Terms; or your violation of any law or third-party right. We'll promptly notify you of any claim and cooperate with your defense at your expense.

Governing law and disputes

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law rules. Disputes must first be attempted in good faith over email for 30 days. If unresolved, disputes go to binding arbitration in Wilmington, Delaware under the American Arbitration Association's commercial rules, except that either party may seek injunctive relief in court for urgent IP or security issues.

Changes to these Terms

When we change these Terms materially, we'll update the "last updated" date and email all account holders at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance. If you don't accept the changes, you can cancel and receive a prorated refund for the remaining paid period.
